Police Chief Kull?

What do you think of the mayor’s choice for police chief? Mayor Larry Beesley announced today he has chosen David Kull, a captain with the Sioux Falls Police Department.

The mayor told me that he narrowed the three finalists down to two and then talked to both of them before he made his choice. “Both of them were extremely interested in the position,” he said.

The City Council will vote to approve or not approve the mayor’s choice during the next regular council meeting, Jan. 7. The council has a planning meeting Thursday. The mayor said the council may talk about the choice that day, “but we don’t take any action at those meetings,” he said.

Kull graduated from Washington High School in 1974, from South Dakota Law Enforcement Academy in 1978 and from the FBI National Academy in 1994.

If the council approves the mayor’s appointment, Kull will begin work in Brandon in late January.

    Never “blogged” before. I have however, been watching the process. Good luck Chief, it appears you may need it. I have only lived in Brandon for a short period but I have learned alot in that time. People seem to spend too much time whining and crying about personal perceptions no matter what the topic. It seems to me that time would be better spent offering workable and real solutions. I hope Chief Kull is afforded that opportunity and not buried alive in local politics. Talk is cheap, appropriate action speaks for itself.

    As you work your way through the blogging process, whether it be here or anywhere else on the Internet, you will discover that people who care will write their concerns, comments, suggestions, etc. You have to sift through those that make personal attacks, and try to ignore those people. Blogging is a public forum, and the intent is to invite people to voice their opinions. And, just as you have voiced your opinion, so have others, and they should be able to do so without retribution, or being told they are “whining and crying about personal perceptions.”

    You said “time would be better spent offering workable and real solutions.” Yet, your entry on this page as well as the ambulance issue page do nothing more than blast the people that have written entries. Where is the workable and real solution that you said others should offer?

    I am extremely glad that the Mayor has appointed Captain David Kull as Brandon’s new Police Chief. After reading his bio and seeing his experience with the Sioux Falls PD I believe this was a great choice and is a great opportunity for the Brandon PD and Brandon as a whole. I am very happy with this decision. Congratulation Mr. Kull and welcome to Brandon.

    #4, You make absolutely no sense. I think #3 was trying to say that this community does a great deal of complaining and not enough acting. It is easy to point out what is wrong but it is difficult to stand up and change it. We have a lot of people that want to point out everyone else’s flaws, especially those of the people that are willing to be leaders in our community. If people want to see to changes then get off the computer and get some things done. Run for mayor, show up at the meeetings, support the community rather than complain about how its going to fall apart because of an ambulance service or a bigger gymnasium. We are a growing community and there are going to be growing pains. Deal with it. We are a model community for the entire area and if someone from Podunk, SD were to come on here and read these blogs they would think this place is nothing but whiners. Lets keep this a place that people want to come to. Support your elected officials rather than drag them through the mud. Good Luck Mr. Kull

    How do you know the complainers as you call them haven’t run for office, or shown up for meetings, or spoke against an issue to our city leaders? I personally know many who have, and yes that includes me.

    Model community? That depends on personal viewpoint. Model for what? I don’t think you can lump everything together. All towns have good and bad aspects. Everything in Brandon is not “model” and to think so is unrealistic and egotistical. We are just one blip on a huge map and everyone thinks the town they live in is the best. Reality is, there is no such thing, all towns have “issues.”

    I’ve heard many people express negatives about Brandon. Too expensive, too snobby, the houses all look alike, it’s all about me attitude, your new street has a ridiculous amount of signage, who spent all that money? What’s wrong with your police department, what’s up with the ambulance ordinance. anyway, you get my point.

    Start a blog for any other community and you will get the same thing. That’s kind of the whole point. Dicussion is good, it makes people aware of what the issues are in their community, it gets people motivated to serve. It educates people on the issues.

    Check out the Argus Leader Forums or Blogs if you want an example of complainers and whiners and good discussion to boot.

    People support the elected officials they believe in. They fight the ones who have lost their respect. That’s what’s great about America…we don’t have to support the ones we think aren’t so good. If I get poor service or food at a restaurant, I surely don’t continue to support it, I find a new one that serves me what I came for.

I have worked with Captain Kull many times over the past several years and know he will be a fabulous addition to this community.     Yeah I’m starting to figure that out, #8 was right about my original thoughts. I did see the interview on tv with Capt. Kull, I would have been interested to hear more of what he has to say. Effective leadership is always a plus in my book. Although I’m somewhat of an outsider it seems to me that Capt. (er, Chief Kull) has the right stuff. To my knowlege
    no other officers have left the department since the retirement of the last chief, so I can only speculate as to why the turnover was so high before. When I learned about the City Officials trying to outsource the police services I really started to wonder why someone would want to do that? I’m definately going to pay alot more attention to local politics and were I cast my vote in the future. Thanks for listening (old and tired doesn’t always translate into a good nights sleep)

    Once again the council demonstatrates their passion for incompetence and lack of leadership. They take the easy way out and bring in an “outsider”. We do not know all the facts in regards to personnel records and qualifications but, it all smells funny to me.

    In my opinion it shows a great amount of leadership to choose someone as qualified as Chief Kull. It does not and should not matter if he is an “outsider” or not. He will bring many new ideas to the BPD and the city of Brandon. Fresh ideas should always be welcome!

    I am also confused about your last sentence - what are you implying? I think Chief Kull’s qualifications are very clear. Nothing smells funny to me.

    #15, you make me laugh!!! I think the Mr. Beesley has shown great leadership in this case and pick the most qualified person for the job. That is what he is supposed to do and I believe it was a hard decision, but the right one. You can’t actually believe that Sgt. Else was as qualified and experienced as Dave Kull.

    You also better look around you, most of the people that live in Brandon are would what you call “outsiders”. This is the kind of thinking that makes our town look small, uneducated and petty.

    Congratulation Chief Kull, you are just what we needed.

    I’ve known Kull for several years through work. He’s a good, solid and professional law enforcement officer. I don’t know any details about the other candidates for the chief’s job(other than what I’ve read here), but I believe Kull will do a great job.

    I had the privlege of working with Dave Kull for 25 years and have also been proud to call him a good friend for nearly as long. Dave was an excellent choice for this position and will be a real asset to the department and community. I am aware of only one unfortunate habit that he has that the citizens of Brandon should be aware of…he plays the bagpipes. Nobody is perfect!

    I sincerely agree w/the choice…new voices/ideas/thoughts are ALWAYS a good thing. My 1st question was, will he be moving to Brandon…or does he already live here? Is it part of the deal that he has to live in the city proper…?? SDMouth…which part smells funny? The recruitment/interview process, or the fact that an outsider was brought in? I know I speak for more than one parent when I say that I am the most comfortable with my children growing & playing in Brandon, and that has alot to do with the police officers enforcing things like SPEED LIMIT, LOITERING, CURFEWS, etc. These types of violations are the things that will escalate in a hurry to cause bigger problems. I am proud of the fact that our police force has a “tough” reputation because then I know that any bad element will stay away.

    I know Dave, he has worked as the Division Commander for Patrol, Investigation and Community Services. He also has great knowledge in incident management and was a great pick. We are very lucky to have him. I wish him all the best.

    You have got to be out of your freaking mind if you think this pick shows good “leadership.” Beesley blows with the winds of of the people more than the windsock at Joe Foss Field. That man has NEVER had an independent thought or an ounce of Leadership since he was elected. He can’t possibly be counted on or get credit for anything that he did on his own. Fortunetly for him, he IS smart enough to know when it would be wise to make a decision like this. Dave Kull was and is the BEST choice. Now the question is, does Wade ELse have the Character to swallow his pride and stay on the Department and NOT sabotage Dave’s leadership from within. From what I know of Else, I wouldn’t be surprised if he does his best to derail the success of our new chief. I hope..NO I pray, that I am wrong.

    I certainly hope that no one will purposely sabotage the success of the BPD. It would certainly be sad for our town if that was to happen.

    No need for Officer Else to “swallow his pride”. He is a fine policeman and should be proud of his accomplishments, of which he has many. I hope he stays with the department. He has many skills and it would be a loss for our town if he left. He may find that it was best that he didn’t get the Chief job - things always happen for a reason……

    I think David Kull sounds like a good choice. He comes from a larger police force and knows the types of rules and procedures they have to make things work smoothly. If Brandon’s police force keeps up with our population growth, we will need those types of procedures in place to ensure an orderly growth. Our current force should be using Mr Kull as a mentor to learn how things work in a larger town - not necessarily better or worse, just different. He will need their help to understand how Brandon works and hopefully the end result will be greater than the sum of the parts. Only time will tell.

    Mr.Kull will be good for the department, I just hope that he will calm down some of attitude of some of his officers. The “practice what you preach theory”. How is it that a certain officer can hammer people for DWI’S and than sit at Tailgaters, have a few beers and drive himself home. Makes a lot of sence for him to enforce the law when he is breaking it himself!!!

    Anyone can have a few beers and drive themselves home as long as they are not too intoxicated or over the limit to drive. The problem is when somebody drags themselves off the floor of the bar and staggers out the front door and drives themselves home.Be ready to face the results when you can not pass the sobriety test. Don’t bash the officers that try to keep everybody safe from those kind of drunk drivers.

    #36, The only problem is, and if you are a Police Officer you should know this, is that consuming any amount of alcoholic beverage will impair your judgment and reaction time. Also I believe if you are a Police Officer you should be held to a hire standard, because like you said you are tasked with keep the City and it’s residence safe, so why would you go out drink and them get into a car and drive and put them in danger. The statement you said; “ The problem is when somebody drags themselves off the floor of the bar and staggers out the front door and drives themselves home.”, that is true, but again the standard is .08 and that is not past out, falling down drunk on the floor. The safe thing is that if you go out and drink, you have a sober designated driver and if you are any kind of Police Officer you should know that.

For what they have gone through in the last few months with the whole county thing and waiting to see if they were going to get a decent Chief they deserve to have a beer or 2.     Just to enlighten everyone about drinking and driving. I learned (while serving on grand jury duty) that anyone can be picked up for driving under the influence - regardless if the blood alcohol is .08%.

    A person (over age 21) can have a blood alcohol content of .01% and still be charged with one count of DUI. This person would have to be stopped for a legitimate reason, driving poorly, and/or fail the sobriety test. If the blood alcohol is over .08% it would be the second count of DUI.

    Did anyone ever get charged with one count of DUI - yes. Of course, that being said, the blood alcohol was higher than .01 but lower than .08. This was definately an eye opener to me.

    So, #36 your statement is incorrect. Also, does everyone know just how much they can drink before they are impaired? I personally know I am over the limit of .08% at 1/2 to 3/4 of a beer. It really doesn’t take too much!

    I agree with poster #37. No amount of alcohol is legal or safe when driving. Either don’t drink and drive or get a designated driver. This goes for everyone - police officers, etc.

    #39 I believe you are incorrect. Her we go again with people speaking things they know not much about. I learned in Criminal Justice class that 1; 12oz beer will take you to .020%. Wait 1 hour, don’t drink anymore, you should be back to 0%. 1 12 oz beer, 1 regular hard liquor drink, or 1 shot should all equal about .020%. Of course there are other factors that go into this as to weather or not you drink often, did you have them with food etc… Can you be charged with DUI for being UNDER .080%, not if you are 21? If you driving a commercial vehicle with a CDL or under the legal drinking age, yes you can be charge being under .080%. Just a FYI! So if you drink, keep it under 4 beers and eat some food, don’t be a lush. Every RESPONSIBLE person should know their limits.

    Sorry #40, I have to disagree with your statements. EACH and EVERY person handles their alcohol differently. Yes, food intake and timing/spacing of alcohol intake are factors. But other factors include: fat vs. muscle, body type, body SIZE, gender, etc. The facts from your criminal justice class are probably for an adult male of average height/weight.

    And I know for a fact that individuals (any age) can be charged with ONE count of DUI with a blood alcohol content of less than .08%. Any license, not just commercial.

    FYI - I was on grand jury duty for 16 months. We met every other week for a FULL day. The mornings were filled with misc. cases, BUT the afternoons were ALL DUI - roughly 25-30 per day. Definitely an eye opener at first but then it just got long and boring.

    PS. I hope you are not driving after your 4 beers and some food….UNLESS those 4 beers are spread out over a long evening. Maybe a DD is in order….

I personally did not realize the under .08% stuff - I even questioned the lawyers (as did the other jury members) to try and fully understand how it works. I guess I still don’t fully understand why they even have the .08% to begin with.

    I was just trying to help people understand to NOT drive with any alcohol in their system. It just isn’t wise due to the many potential consequences.

    ANYWAY, lets get the topic back on track. Chief Kull will be a great addition to our already great BPD!

    Just FYI to Support BPD: It is possible to be convicted of DWI if you are 21 or over AND have a B.A.C. lower than 0.08%. This is possible if impairment can be proven, i.e. failure of the sobriety tests, bad driving, etc. DWI can be charged two ways: by proving impairment OR proving a BAC of 0.08% or higher (which is usually the route taken when a blood test is available). If you read the statute the 0.08% BAC is one of five different subsections to this law. The other four all require impairment to be proven. http://legis.state.sd.us/statutes/DisplayStatute.aspx?Type=Statute&Statute=32-23-1

    To Northern Lights: I doubt you are at 0.08% BAC after ½ to ¾ of a beer. I suppose this is possible if you weigh less than 100lbs. I also wonder how you “Know” this. Do you have an alcohol tester you use on yourself? Also are you saying a person can be charged with 2 DUIs from the same arrest???

    Heath - A little self-control goes a looong way. Your language is extremely offensive! Think about the example you are setting for your children - I am sure they are so proud of your behavior in recent months.

    You should consider putting more emphasis on getting your act together versus lashing out at “Community Advisor”. It is a bit dramatic that you have a “private investigator”. Money might be better spent on counseling or a life coach.

    You had so much potential a few years back. It has been sad to watch your life spin out of control. Step out of the spotlight and get some help for yourself and family….

    WOW! Shawn Richardt, the KING of someone who is truly the pot calling the kettle black. Perhaps if you took the time to call Heath and ask him what was going on, rather than getting third and fourth hand baised accounts, and your vailed threats are a joke. I’m sure you have his number, better yet, you come to Brandon, I’m sure the fine members of the BPD would love to meet you. They are already aware of your presence, record, and demeanor. It’s no secret, and Heath will be the first to admit that he had an improper relationship while he was married that he regrets. Infidelity is nothing new (unless you’re perfect Mr. Richardt, I’m told you’re not)however it is something that takes alot of work to get beyond. Both parties have to want to, without alot of negative “discouragement” from those on the sidelines. Let’s address each of these lies and then my time with you will be done; poorly spent that it is.
    1)Children are the product of two parents and Godwilling will have the good fortune to have them both in their lives. No matter what you think.
    2)What exactly was “done” to your sister? According to public record, and yes I’ve read that record, both parties admitted to injuring the other. One admitted to biting the other, while the other admitted to pulling the other’s hair. The court DID NOT FIND ANYONE guilty of Domestic abuse. Again, no matter what you would like to think.
    3)The Tahoe was surrendered in a bankruptcy by your sister even though Heath was working out refinancing. In reference to DUI’s, it is public record and Heath has been charged and sentenced and severed punishment for ONE COUNT of DUI. With that in mind, how many have you been convicted of and how long have you lost your license?
    4)I have seen Heath driving the van you refer to and I would assume that it is current in payments and have valid paid insurance or it would be repossesed and the SR-22 would be revoked without valid insurance.
    5)Once again, I have seen in public notice that the family has filed Bankruptcy and has likely forclosed on the House due to that Bankruptcy. Why make payments on something you aren’t going to own anymore. However, as far as I know Heath still lives in the same house he has always lived in. Maybe he has found a way to keep the house. I do know that he has worked hard to bring the family back together under that roof.
    6)Finally, I’m sure the family thanks you for all of your prayers as they need them in this very difficult time for EVERYONE. I see Heath and his boys in Church on a regular basis. I haven’t seen your sister in quite sometime. I’m sure that should be blamed on Heath too, right? One finally note, you might want to consider holding off the published threats against anyone Mr. Richardt, that can and WILL get you into trouble. P.S. How are those multiple NSF check charges etc. in Grant County going for you, and has your family gotten over your Father’s “Theft of Goverment Property” when he was a warrant officer with the SD National Guard? Throw stones my friend and do so from something other than a glass house. I talked to Heath within the past hour and his phone number still works. Feel free to give it a try.

    To your #3 statement, why wouldn’t Mr. Nice Guy’s wife surrender the truck if they were getting divorced? I wouldn’t want my drunken Ex driving my vehicle around either why not get rid of it.
    #4- Yes, I have seen Mr. Nice Guy driving around Brandon, I live here, see him all the time. Maybe I’ll make the BPD aware he has no insurance.
    #5- My guess, if there is a protection order in place is why you would not see the wife in church with Mr. Nice Guy. I would not want to spend any amount of time with the man either after what he has and continues to put his family through!
    And the charges just keep on coming; I did hear that Mr. Nice Guy was spotted getting into the back of a BPD cruiser last week, any truth in that Mr. Nice Guy? I bet that is another false charge?     #53 I think you are misguided. Mr. Tople was ONCE AGAIN arrested this week for violating a protection order. It was in the Brandon newspaper’s police record. I assume the BPD did the arresting. Heath just can’t seem to get himself together.

    I have not seen any references to his wife/ex-wife in the newspaper (other than the foreclosure notices). I am assuming she is not at fault here. It is also inappropriate to try and bash Mr. Richardt’s record (I don’t know him and don’t care). He is not the problem in the Tople’s situation.

    In regard to your comment #1 above. Yes, it does take two to create a child. It is NOT always in the best interest of the children to have both of those parents involved in their lives though. In this case, Heath probably should step back and deal with his problems before he creates even more problems for his family. Kids learn by example - both good and bad. I would hate to think his boys would grow up and treat their families as they have learned from Heath on how he treats his family.

    Going to church doesn’t neccessarily make you a good person. It means you go to church. By the way, did you ever consider his wife may attend a different church? One in SF possibly? I have no clue personally, but it could be a possiblity.

    Finally, you sounded like you were throwing a threat of your own to Mr. Richardt. “The fine members of the BPD would love to meet you”. Sounds like you and Heath have the BPD insider track…Not good……

    The previous blog #51 are family motivated that SHOULD NOT HAVE BEEN placed in this forum. I can safely assume some people have family differences they prefer were not communicated to the whole town.

    I know I can say this about Tople. Did he make mistakes? Yes. Is he paying for those mistakes? Yes. Will he and his family survive this period in their lifes? YES !!! Because they deserve it.

    My favorite religious poem is “Footprints in the Sand” I sure hope GOD is carrying the Tople Family during this difficult period.

    I don’t know what to say. I’m saddened, ashamed and tired of all of this. The single most important thing to me in this world is my family!! I made an incredibly bad mistake and some horrible decisions that led to more bad decisions and terrible consequences. I have and will pay for my poor choices, however I beg any and all to please spare my wife and boys who had nothing to do with all of this. It is my deepest and most sincere hope that my wife and I can reconcile and work through our differences and I can work to earn her trust and be the Father that my sons deserve. Mr. Tople’s children have nothing to do with this and even if their father is a wreck they don’t need to read what people write about him. I would imagine that most of us wouldnt want our children to read about all of our baggage. A little empathy for the family, if not for Heath, goes a long way.
